View Full Version : Derestricting--Legal issues?

I'm still waiting on parts to make my Vino street legal, and getting the itch to do the derestrict.

Does anybody know if derestricting makes the Vino illegal in California? I ask because I still have to get the thing inspected by the Highway Patrol because it was a salvage. I don't want to derestrict and then get nailed for it in the inspection.

My thought is that since there is no reason it needs to be under a certain horse power (all 50cc's are now motorcycles in CA) that I should be fine. I know that a bore upgrade would be not ok (50cc limit on two strokes in CA), but any reason I couldn't do the derestrict?

The restrictor is only for states that have speed/H.P limits on scooters/mopeds. I also think that after the C.H.I.P. inspection, you should do a 70cc kit.;) :D

Samuelet, I would wait to de restrict it because I know this is the law in Pleasanton but I'm not sure about county or state....In Pleasanton, (about a half hour south east of you) you can get a ticket on a bike for having anything other than stock exhaust on it. Now whether or not the cops enforce it is a different issue, but it is the law and I know that because my dad is a car and motorcycle dealer in Pleasanton. Let me re-emphasize that it is not strictly enforced-it's really more like if someone complains then they've got you but they don't come looking for you. So just to be safe I would get that inspection done first and THEN go to town if you know what I mean. :)

Technically in MD, I could get nailed for not having tags on my scooter if not for having a motor license, and being an ex-cop. So you do need to be careful. Though technically you can ride a derestricted scooter as a moped, you can't ride over 30mph legally in many states. Keeping my FOP card has benefits, LOL.

KING VINO, you dont have TAGS on your Scoot.

I Think The benefits of having a motor license gives you The Speed that you need from what i know With out One, You will have To Stay Below 30 mph sounds about Just Right?

they wouldn't be able to tell you did a de-restrict they'd have to take the exhaust off,and transmission cover that would be the only way.
