In South Carolina a person of the age of 14 with parental signature can hold a valid daytime moped licence. The Moped must be 49cc or less and the rider must wear a helemt at all times the vehicle is on public road ways an or the vehicle is in motion. At age 16 the rider can hold a full moped lience valid day and night. The rider must wear a helemt until age 18, but I have seen this rarely enforced. Any moped 50cc or over must be insured and is subject to standard vehicle taxes. All mopeds must be registered (generic moped plastic licence plates). Any moped over 250cc is considered a motorcycle. A standard motorcycle only licence can be aquired at the age of 18. You can legally drive a motorcycle if you have a valid class d (car) driver's licence and you are over the age of 18. A motorcycle only licence does not permit you drive a car though. Makes sense, huh? I can't remember the classicifation for the motorcycle only licence few people have these. One more interesting fact: all SC public schools prohibit a student from driving and parking their motorcyle in the student parking lot (school property). There is no policy for mopeds or destinction between the two. I however did ride a scooter to school. I just didn't park in the student paking lot(public parking). Maybe this helps someone.

I should also add that most scooterists here buy 49cc cycles but perform engine swaps and/or upgrades as opposed to paying for insurance and vehicle taxes. Most cops don't know the difference or what exactly the laws are.
