are their any open element filters that you can get wet,and still have the scooter run ok, maybe 1's that are covered so they dont get wet?

lol, its called an airbox. since you are planning on using a small carb then you still can use your airbox. if you can get the bike jetted right with the box on then do it. your bike will be a lot more quite and will sound really deep. just get some good packing for the evo pipe to cut down on the pipe noise.
